Review of the General Permitted Development Order 1992: Householder Report

This report presents findings from the Stage 1 Review of the General Permitted Development Order as it affects householder development. It includes an analysis of relevant statistical data and other research, responses to a survey of planning authorities and other stakeholders, and recommendations for amending the GPDO in relation to householder development.

1 Introduction

Within the context of the current research on the review of the General Permitted Development Order (the GPDO), a main objective is "to consider in particular the potential to deregulate householder developments under Part 1 of Schedule 1 of the GPDO, and establish appropriate new parameters for permitted development" 1.

This Report is prepared in fulfillment of this objective. It identifies the scope, and sets out proposals, for householder development management in Scotland, including the planning permissions granted under Parts 1 and 2 of Schedule 1 of the GPDO. The Report comprises:

(i) Analysis of the extent of and trends in householder developments, utilizing statistical data from the Scottish Executive and local authorities;

(ii) Analysis of a sample of 50 householder development cases decided in 2003/04 and 2005/06;

(iii) Analysis of responses to the householder options questionnaire widely circulated in December 2005, including the scope for aligning exemptions in Regulations 3 and 5 of the Building (Scotland) Regulations with permitted development rights for householder development as they currently exist, as required by the Research Specification;

(iv) Analysis of previous research on householder permitted development;

(v) Appraisal of the potential applicability in Scotland of recommended reforms to the householder development consent regime in England;

(vi) Exploration of the scope for extension of householder permitted development, including consideration of alternative methods of control that might be applied to those householder developments which may not have permitted development rights, but would not necessarily warrant a full planning application;

(vii) Recommendations for reform of current procedures for householder development consents;

(viii) Audit of recommendations against the sample of 50 householder development cases to estimate the likely impact on householder development applications.

The research objectives for the review of the GPDO as a whole are listed in Appendix 1.
